Terms of Service

Kymo (“the Service”) is owned and operated by Volaris Labs, a Volaris Solutions Group company (“Volaris Labs”, “we”, “us”). Our corporate domain is volarishq.uk. You can reach us at legal@volarishq.uk.

By creating an account, generating an API key, or otherwise using the Service, you agree to these Terms. If you use the Service on behalf of an organisation, you confirm you have authority to bind that organisation.

You must be at least 16 years old (or the minimum age of digital consent in your country, if higher) to use Kymo.

You are responsible for all activity under your account and for keeping API keys secret. Kymo keys are shown once at creation and stored only as a hash; we cannot recover them. Revoke a compromised key immediately from the API keys page and notify us at security@volarishq.uk.

You must not use the Service to:

• break any applicable law, or infringe anyone’s rights;
• generate or distribute child sexual abuse material, unlawful sexual content, or content that sexualises minors;
• produce targeted harassment, hate speech, incitement to violence, or content that promotes self-harm;
• create malware, phishing content, disinformation campaigns, or material intended to deceive people about its AI origin in a harmful way;
• submit personal data you are not entitled to process, or special-category data, without a lawful basis;
• probe, scrape, resell raw capacity, circumvent rate limits, or reverse engineer the Service or the models behind it.

We may suspend or terminate access without notice for violations, and may remove or refuse to process any request.

The Service applies per-key rate limits and may throttle, queue, or reject requests to protect platform stability. Limits may change; the current limit is documented in the API documentation.

You keep all rights in the prompts, files, and images you submit (“Input”) and, as between you and us, in the model output returned to you (“Output”). You grant us a limited licence to process Input and Output solely to operate, secure, and support the Service.

Output is generated by statistical models and may be inaccurate, offensive, or unsuitable. You are responsible for reviewing Output before relying on it, and for any use you make of it. Output may not be unique; similar Output may be produced for other users.

Kymo routes inference requests to third-party compute providers, including Groq. Your Input and Output are transmitted to those providers to fulfil your request, subject to their security and data-handling commitments. We do not sell your data.

The Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted availability, and we may add, modify, deprecate, or remove models and features. Where a change is material and adverse, we will make reasonable efforts to give advance notice.

Where paid plans or usage-based charges apply, pricing and billing terms are presented at the point of purchase and form part of these Terms. Free-tier access may be limited or withdrawn at any time.

To the fullest extent permitted by law, Volaris Labs excludes all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill. Our aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amounts you paid us for the Service in the 12 months before the claim, or (b) GBP 100. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be limited.

You will indemnify Volaris Labs against claims, losses, and reasonable costs arising from your Input, your Output use, or your breach of these Terms or applicable law.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for breach, legal risk, or non-payment. On termination, your right to use the Service ends and we will delete or anonymise your data as described in the Privacy Policy.

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, without prejudice to mandatory consumer protections in your country of residence.

We may update these Terms. We will update the date above and, for material changes, notify account holders by email or in-product notice. Continued use after the effective date constitutes acceptance.
